Terms of Service

These Terms of Service ("Terms") govern your use of the Brownsville Drive-In Hub app and website (the "Service") operated by Brownsville Drive-In ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of Service
The Service allows customers to browse movie schedules, purchase tickets and special admission packages, register for special events and flea markets, apply as vendors, and pre-order concession items for pickup or delivery to their vehicle. The Service also provides staff-facing tools for box office validation, kitchen order management, point-of-sale operations, reporting, and administration.
2. Accounts
Customer-facing features (browsing, purchasing) do not require an account. Staff and administrators must register for an account and are invited by the business. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. You may delete your account at any time through the app.
3. Ticket Purchases and Admission
- Tickets purchased online are valid for the specific screening and date shown on the order confirmation.
- Admission is per person unless otherwise stated. Car count is collected to manage capacity.
- Tickets are validated at the box office via QR code scanning. Each ticket may only be used once.
- Prices, fees, and taxes are calculated at checkout based on the rates configured by management and are subject to change.
- Some screenings offer reserved parking spaces via a seat map; selecting a premium space may incur an additional charge.
- Capacity is limited. If a screening is sold out, online purchasing will be disabled.
4. Special Admissions and Packages
Special admission packages (e.g., fire pit packages) include the items described at the time of purchase. Add-ons selected at checkout are included in the order total. Quantities are limited per screening and sold on a first-come, first-served basis.
5. Concession Orders
- Concession pre-orders may be placed with a ticket purchase or as a standalone order, subject to availability.
- Online concession ordering may be temporarily paused during busy periods; in that case, checkout is disabled and a banner is shown.
- Delivery orders require vehicle details (make, model, color, license plate, screen number, and parking area). You are responsible for providing accurate information so staff can locate your vehicle.
- Delivery location sharing is optional but helps staff find your vehicle faster.
- Tips and delivery fees, where applicable, are calculated and charged at checkout.
6. Special Events and Vendor Registration
- Special events (flea markets, fire pit events, movie events) have their own pricing, capacity, and policies as displayed on the event page.
- Vendor applications require business and contact information and are subject to approval by management.
- Vendor registration fees are charged at the time of application. Approval is not guaranteed; if rejected, any applicable refund will be processed per our refund policy.
- Vendors must comply with all applicable laws, regulations, and event rules while on the premises.
7. Payment
Online payments are processed by Stripe. In-person payments may be processed by card (via Stripe) or cash. By making a purchase, you authorize us to charge the selected payment method for the total amount shown, including any applicable processing fees, service fees, and taxes. If a payment fails, your order may be cancelled.
8. Refunds and Cancellations
- All sales are final unless a screening or event is cancelled by management.
- If a screening or event is cancelled, we will refund the purchase price to the original payment method.
- Refunds for extenuating circumstances are at the sole discretion of management. Contact us through the Contact page to request a refund review.
- Orders left incomplete (abandoned) are not charged; no refund is needed for unpaid orders.
9. Weather Policy
Screenings and events operate rain or shine unless a rain-date policy is specified. When a rain date is configured, the backup date and time will be displayed on the screening or event page. Management reserves the right to cancel or reschedule due to severe weather; affected purchases will be refunded or honored on the rain date.
10. Conduct and Safety
- You agree to follow all posted rules and staff instructions while on the premises.
- Vehicle operation on the premises must be safe and cautious, especially during low-light conditions.
- You are responsible for your vehicle, passengers, and personal belongings.
- We may refuse service or require anyone to leave the premises for disruptive, unsafe, or unlawful behavior.
11. Digital Wallet Passes
Where offered, Apple Wallet and Google Wallet passes are provided for convenience. Availability of a pass does not guarantee admission; the underlying ticket or order is subject to validation at the box office. Pass functionality depends on your device and wallet app and may vary.
12. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to circumvent payment, capacity limits, or validation systems.
- Resell tickets or packages without authorization.
- Interfere with or disrupt the Service, including servers, APIs, or QR validation.
- Provide false or misleading information when placing orders or applying as a vendor.
13. Intellectual Property
The Service, including its design, content, branding, and software, is owned by Brownsville Drive-In and its licensors. Movie posters, trailers, and synopses are property of their respective rights holders and are displayed for informational purposes. You may not copy, modify, or distribute Service content without permission.
14. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that all features will be available at all times. Movie titles, showtimes, and schedules are subject to change without notice.
15. Limitation of Liability
To the fullest extent permitted by law, Brownsville Drive-In shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid through the Service for the transaction giving rise to the claim.
16. Indemnification
You agree to indemnify and hold harmless Brownsville Drive-In and its staff from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your conduct on the premises.
17. Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you within the app. Continued use of the Service after changes constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Fayette County, Pennsylvania.
